通过科学立法促进民族交往交流交融的法理探讨

在中华民族“多元一体”背景下，加强各民族交往交流交融，是铸牢中华民族共同体意识的必然要求。而通过科学立法建立完备的法律规范体系，则是运用法治思维和法治方式，促进各民族交往交流交融的根本前提。当前我国的民族法律规范体系虽已基本建成，但仍存在一些法律原则的表达不够严谨、法律概念的界定不够准确、法律规则的内容不够明晰和完整、规范体系的结构不够完备和和谐等缺陷和不足，难以满足在政治、经济、文化、社会和生态建设中通过法治方式有效协调民族关系，促进各民族交往交流交融的需要。这就要求立法者应遵循《立法法》确定的科学立法的形式合理性和实质合理性的要求，妥善处理法律规范体系与现实需要的适应性和可执行性，由此才能为通过法治促进各民族交往交流交融奠定坚实的制度基础。从科学立法与依法立法、民主立法的关系来看，遵循依法立法，是保障法的形式合理性的前提；坚持民主立法，则是保障法的实质合理性的根基。为提升立法的科学品质，必须健全违宪审查机制、协商民主机制和立法理论形成机制，确保依法立法、民主立法原则的有效落实。     

传统农业乡镇城镇化的实践逻辑--以山东省平阴县孝直镇为例

随着城镇化进程不断加快，城镇功能和城市文明向农村地区的扩散已成为一种必然。对于传统农业地区，城镇化的关键在于立足自身资源禀赋，对城镇化的路径和推进机制做出切合实际的选择。在这方面，山东省平阴县孝直镇借助新型农村社区建设和农业现代化推进新型城镇化的模式为研究分析此类问题提供了一个可资借鉴的案例。

先秦的“法治”思想和实践考量

先秦法家在与儒家“礼治”的争论中提出“法治”思想,并与战国时期富国强兵的国家策略结合,变法图存的“法治”实践此起彼伏。其中最为成功的是秦国的商鞅变法,秦国由此迅速崛起并最终吞并六国,建立起统一的封建国家。秦帝国的建立是“法治”思想和实践的里程碑,大秦将集权专制和“法治”相互糅合,将法家重刑思想发展到极端,走向了崇尚暴力和滥刑滥杀的野蛮恐怖境地,导致天下怨叛,秦王朝二世而亡,君权至上最终将法治引向了集权专制的死胡同。

Behavioral Determinants of Nonprofit Board Performance

There is an increased awareness that the performance of boards (good governance) is not only determined by structural determinants but by behavioral determinants as well. These behavioral determinants might be particularly important for public and nonprofit governance, where the role of the board is more diffuse and heterogeneous than in corporate governance. Here we investigate how social dynamics within boards in secondary education influence their performance. We follow a concise model that includes cognitive conflict, the use of expertise, effort norms, and social cohesion as determinants of board task performance. A survey among all secondary schools in the Netherlands serves as the empirical underpinning for this process‐oriented model of good governance. We show that the behavioral determinants have different effects on the control task and advice task of boards. Also, we find that cognitive conflicts in supervisory boards do not lead to less but rather to more social cohesion within boards. Building on these findings, we suggest a revised model of the behavioral determinants of nonprofit board performance.     

From comedy targets to comedy-makers: disability and comedy in live performance

The stand-up comedy landscape has been transformed in recent years with an increased number of disabled comedians performing. Using semi-structured interviews with disabled comedians, this article provides a thematic analysis of the material and ideological motives, intentions and lived experiences of disabled comedians. Two themes are discussed: comedy management and control; and affirming disability through comedy. These themes are characterised by complexity and contradictions. The article concludes that, although not a straightforward process, stand-up comedy enacted by disabled comedians is potentially a powerful tool through which hegemonic norms around disability can be challenged and renegotiated.     

Journey towards independent living: a grounded theory investigation of leaving the care of Girls & Boys Town,South Africa

The journey out of care and towards independent living is a challenge for many care-leavers. There has been little research into the social processes involved in this care-leaving journey. This paper presents the results of a grounded theory investigation into the care-leaving journeys of nine young men who had, several years previously, been in the care of Girls & Boys Town in South Africa. Working from a resilience perspective, with an ecological emphasis, four central social processes emerged that together explain the care-leaving experiences of the participants. These processes are striving for authentic belonging; networking people for goal attainment; contextualised responsiveness and building hopeful and tenacious self-confidence. These four processes are located within contextual boundaries and at the social environmental interface. The paper presents these processes in detail, drawing on selected narratives of the participants and integrated with additional theory. It is hoped that this paper may contribute to theory building concerning care-leaving processes and enhance youth care practices for youth in care and leaving care.     

Do information,price, or morals influence ethical consumption? A natural field experiment and customer survey on the purchase of Fair Trade coffee

We address ethical consumption using a natural field experiment on the actual purchase of Fair Trade (FT) coffee in three supermarkets in Germany. Based on a quasi-experimental before-and-after design the effects of three different treatments – information, 20% price reduction, and a moral appeal – are analyzed. Sales data cover actual ethical purchase behavior and avoid problems of social desirability. But they offer only limited insights into the motivations of individual consumers. We therefore complemented the field experiment with a customer survey that allows us to contrast observed (ethical) buying behavior with self-reported FT consumption. Results from the experiment suggest that only the price reduction had the expected positive and statistically significant effect on FT consumption.
